As a creator, you would agree that creativity is a beautiful way to express an emotion. We’d like you to associate your Creation with an emotion that signifies what the Creation is all about, or what inspired it. It is tagging with an emotion, literally.

Just the way you tag your own Creation with an emotion, you can react to others’ Creation with an emotional response.

Think about it, all creativity originates with emotions. And all Creations provoke emotional reactions, be it love, hope, joy, sorrow, pride, anger, fear, humour, wonder or just plain boredom. A Creation’s EmoGraf represents the score of emotional responses (EmoTags) by the Qyuki community.

An EmoGraf for a Creator shows all the inspirations that inspired his/her creativity.

Expressions are responses and discussion on a piece of Creation by the community. When you see a Creation, we would like you to respond with an emotion it evoked. Once you have done that, you get a text box to express your thoughts and feedback in detail. What made you feel a certain emotion? What did you like about it, or didn’t? Anything, as long as you keep the interaction meaningful.

Wall Art is a picture you’d like to showcase on your profile. It displayed along with your profile picture while showing search results for people. So put up an interesting image that depicts your creative inclination.

Copyright is a set of exclusive rights given to the owner of any original work of authorship, such as literary, dramatic, musical, artistic works, and audio and audio-visual works. Copyright in a work gives a copyright owner the exclusive right to control certain uses of his work such as reproduction, distribution, performance, display, adaptation, broadcasting and transmission of his work, etc. As copyright is an exclusive right, the copyright owner’s permission is required before any use of his work by a third party in any manner.

Copyright infringement occurs when an exclusive right of a copyright owner is infringed, for example, when a copyright work is reproduced, distributed, performed, publicly displayed, or adapted, without the permission of the copyright owner.

If, in addition to original content, your content comprises any third party content, you are required to obtain the permission of all such third parties prior to uploading such content to the Website.

In order to ensure that the content uploaded by you on the Qyuki website (the “Website”) does not infringe the copyright of any third party, Qyuki requests you to create original content by using your own skills and imagination. This may be achieved by ensuring that all the components of your content are original. For example, if your content is an audio recording of a song, please ensure that the lyrics and the musical works of the song are original. Similarly, if you use an audio track of a sound recording owned by a record label without that record label’s permission, your audio may infringe the copyright of the record label, and may be subject to removal.

Also, please make sure that you follow the other guidelines provided on this Website including, the Terms of Use, Content Guidelines, etc., which are applicable to user generated content.

1. A video made of short clips of copyright content - Yes, it may still amount to copyright infringement even though you edited it and put it together.

2. A separate audio visual recording created from a television or Internet broadcast of a serial or any part thereof, or downloaded it from a website, or made another copy of it from a CD or a DVD – Yes, this may amount to copyright infringement, unless you are the copyright owner of the material recorded or you have the permission from the person who owns the copyright in that material, or your use is considered fair dealing under the Copyright Act, 1957.

Even if you recorded the content free from television, or from a CD or DVD legitimately purchased by you, you still need permission from the copyright holder(s) of the material to make and upload your content.

Giving credit to a third party content owner, without obtaining his prior permission for incorporating such third party content in your content, amounts to copyright infringement and will not release you from a claim for copyright infringement.

It is possible that multiple parties hold rights to different components in a piece of content. For example, a sound recording may comprise of music and lyrics. While the copyright in the music may be with the music director, the copyright in the lyrics may be with the lyricist and the rights in the entire sound recording may be with a record label. It is therefore, necessary that you obtain the permission of the owners of all the components of your content.

IIt may be possible to include small portions or excerpts from any third party copyright material in your content provided the use of such third party copyright material is insubstantial or is incidentally included in your content, or where the intended use of the copyrighted material falls within an exception or limitation to copyright. Qyuki cannot advise on whether or not your use of third party content will ultimately qualify as fair use. If you plan to incorporate even a small portion of any third party copyright material in your content we recommend you take legal advice first.

The right to make an adaptation or a derivative work is a part of the exclusive right granted to owners of copyright in work. Therefore, making an adaptation or derivative work based on any third party content, without the permission of the copyright owner, constitutes copyright infringement

For example, you may incorporate parts of a video into another audio visual and edit it into a new video. Although the new video may be your own creation, the audio and the visuals of the earlier video as comprised in the new video still do not belong to you. You still need permission from the copyright holder(s) of the material you drew upon to make your new creation. Therefore, Qyuki requires its content uploaders to upload only original content.

Qyuki respects the rights of copyright holders and requires all users to confirm that they own the copyright in the content to be uploaded by them or have the required permissions from the copyright holder(s) to upload the content.

Qyuki is only an intermediary with respect to user generated content that is uploaded on its Website. However, uploading content which infringes the copyright of third parties can lead to the removal of such content from the Website. Qyuki provides a Notice and Take Down procedure for owners of copyright content. As per the Notice and Take Down procedure, a copyright owner may notify Qyuki of any content available on the Website that infringes his copyright. On receiving written notification from an owner of copyright of alleged copyright infringement in any content uploaded on the Website, Qyuki may, at its own discretion, remove the allegedly infringing content from the Website with or without prior notice to the uploader of such content. Further, there is also a possibility of legal action such as a suit for copyright infringement, being taken against you by the owner of copyright in such third content.

If you have obtained the necessary permissions to use certain copyright material in your content, you may want to alert the original content owner of your content’s title and address on the Website, to avoid a mistaken removal.

Despite the above, if your video is erroneously removed, you have the option to request a retraction from the claimant. A content owner may always retract a claim of copyright infringement by sending an email to Qyuki at grievanceofficer@qyuki.com.
